1. Acceptance of Terms

By accessing or using Zinel, you confirm that you are at least 13 years of age and agree to be bound by these Terms of Service. If you are under 18, you must have permission from a parent or legal guardian to use this service.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@zinel.app if you suspect any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these terms.

3. User-Generated Content

You retain ownership of all ZINEs and content you create on Zinel.

By publishing content on Zinel, you grant us a non-exclusive, worldwide, royalty-free license to display and distribute your content within the app for the purpose of operating the service.

You are solely responsible for the content you publish. You agree not to post content that:

• Infringes on any third party's intellectual property rights
• Contains nudity, explicit material, or graphic violence
• Promotes hate speech, harassment, or discrimination
• Is spam, misleading, or fraudulent
• Violates any applicable laws or regulations

We reserve the right to remove any content that violates these terms, without prior notice and at our sole discretion.

4. Intellectual Property

The Zinel app, its design, logo, and original content are owned by Zinel and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the app without our prior written consent.

5. Subscriptions and Payments

Zinel offers optional paid subscriptions (Plus and Pro) that unlock additional features.

• Subscriptions are billed through the Apple App Store
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• To cancel, go to iPhone Settings → Apple ID → Subscriptions → Zinel → Cancel Subscription
• We do not offer refunds for partial subscription periods, except as required by applicable law

6. Prohibited Use

You agree not to:

• Use Zinel for any unlawful purpose
• Attempt to gain unauthorized access to any part of the service
• Reverse engineer or decompile any part of the app
• Use automated tools to scrape or collect data from the service
• Impersonate any person or entity
• Interfere with or disrupt the integrity or performance of the service

7. Termination

We may suspend or terminate your account at any time, with or without notice, if you violate these Terms of Service or for any other reason at our sole discretion.

You may delete your account at any time by contacting us at support@zinel.app.

Upon termination, your right to use the service ceases immediately. Content you have published may be removed.

8. Disclaimer of Warranties

Zinel is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The service will be available at all times or without interruption
• The service will be free from errors, bugs, or security vulnerabilities
• Any content stored on Zinel will be retained indefinitely or protected against loss

You use Zinel entirely at your own risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Zinel and its owner(s) shall not be liable for any damages of any kind arising from your use of, or inability to use, the service, including but not limited to:

Content Loss
We do not guarantee the permanent retention of any content uploaded or created on Zinel, including ZINEs, images, and account data. Content may be lost due to technical failures, server issues, or service discontinuation. You are solely responsible for maintaining your own backups of any content you create.

Downloaded Content
We are not responsible for any issues arising from ZINEs or files downloaded through the service, including but not limited to device damage, data corruption, or any harm resulting from downloaded content created by other users.

User-Generated Content
We are not responsible for the accuracy, legality, or appropriateness of any content posted by users. Any reliance on content published by other users is at your own risk.

Service Disruption
We are not liable for any losses resulting from temporary or permanent suspension of the service, changes to features, or discontinuation of the service with or without notice.

Third-Party Services
Zinel integrates with third-party services including but not limited to authentication providers and cloud storage. We are not responsible for the availability, accuracy, or conduct of such third-party services.

Indirect Damages
Under no circumstances shall Zinel be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from your use of the service shall not exceed the amount you paid to Zinel in the twelve (12) months preceding the claim, or USD $10, whichever is greater.

10. No Guarantee of Service Continuity

Zinel reserves the right to modify, suspend, or permanently discontinue the service, or any part thereof, at any time and without prior notice.

In the event of service discontinuation:

• We are not obligated to provide advance notice
• We are not responsible for any loss of content, data, or access resulting from discontinuation
• No refunds will be issued for unused subscription periods remaining at the time of discontinuation, except as required by applicable law

We strongly encourage you to export and back up your ZINEs regularly using the in-app export feature.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify users of significant changes via the app or by email. Your continued use of Zinel after any changes constitutes your acceptance of the updated terms.

The date at the top of this page indicates when these terms were last revised.

12. Governing Law

These terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved through good-faith negotiation before pursuing any formal legal proceedings.
